More Than a Process Server or Private Investigator — Legal Solutions for Cases

More Than a Process Server — Legal Solutions for Illinois Cases

Uthe Investigations & Process Service is often hired to serve legal documents. We are also a licensed private detective agency.

But neither description, standing alone, fully explains what we do.

We are legal solution providers.

By that, we do not mean that we practice law, provide legal advice, prepare pleadings, or replace an attorney. We do not.

We mean something different.

Attorneys, law firms, landlords, insurance professionals, businesses, and litigants frequently encounter practical problems that must be solved before a legal matter can move forward:

Defendants cannot be found.

Addresses are outdated.

Someone appears to be avoiding service.

The facts surrounding an address need to be verified.

Witnessess needs to be located.

Courts need documentation of the efforts made to locate or serve someone.

Attorneys needs reliable information developed outside the courtroom.

Court documents need to be served correctly and the circumstances of that service accurately documented.

Those are not merely “process serving problems” or “private investigation problems.”

They are case problems.

Uthe Investigations & Process Service was built to solve them.

The Law Itself Recognizes That Investigation and Process Service Overlap

Illinois law provides an important foundation for understanding our role.

The Illinois Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act defines the work of a private detective broadly.

Among the activities expressly included within that definition are investigating a person’s identity, conduct, activities, movements and whereabouts; determining the truth or falsity of statements or representations; securing evidence to be used before a court or other investigating body; and serving process in civil and criminal proceedings.

In other words, Illinois law does not treat investigation, evidence development, locating people and process service as completely unrelated occupations.

They can be interconnected functions of licensed investigative work.
225 ILCS 447/5-10.

That distinction matters.

Conventional process-serving assignment may begin with a summons and an address.

A legal-solutions assignment begins with a different question:

What must be accomplished for this case to move forward?

Sometimes the answer is straightforward personal service.

Most times, it requires considerably more.

Illinois Law Also Connects Failed Service With Investigation

One of the clearest examples appears in the Illinois Code of Civil Procedure.

Section 2-203 establishes the ordinary methods for serving an individual in Illinois, including personal service and qualifying abode service.

But Illinois law recognizes that ordinary service is not always practical.

Under 735 ILCS 5/2-203.1, when ordinary service upon an individual is impractical, a plaintiff may ask the court to authorize another comparable method of service.

Significantly, the statute requires the supporting affidavit to describe:

  • the nature and extent of the investigation conducted to determine the defendant’s whereabouts;
  • why conventional service is impractical;
  • diligent inquiries made concerning the defendant’s location; and
  • reasonable efforts that were made to complete service.

The court may then authorize another method consistent with due process.

That is precisely why difficult process service cannot always be reduced to knocking on a door several times.

If a service address is wrong, the solution may become investigative.

When a defendant’s whereabouts are uncertain, the solution may require skip tracing and verification.

After reasonable attempts have failed, the solution may require documented due diligence.

And when counsel ultimately asks a court for alternative relief, the quality of the investigation and documentation preceding that request may become important.

That is where the distinction between simply attempting service and solving the service problem becomes meaningful.

Service of Process Is Part of Due Process

Process service is sometimes viewed as the mechanical delivery of papers.

The law treats it much more seriously.

In the landmark United States Supreme Court decision Mullane v. Central Hanover Bank & Trust Co., 339 U.S. 306 (1950), the Court explained that due process requires notice reasonably calculated, under the circumstances, to inform interested parties of a pending proceeding and provide them an opportunity to respond.

Legal scholarship concerning notice and due process has continued to examine this principle as communications technology and methods of locating defendants have changed. The central issue remains remarkably consistent: notice is not simply a procedural formality. It is connected to the ability of a person to know that judicial proceedings may affect his or her rights.

Federal law reflects the same importance.

Federal Rule of Civil Procedure 4 establishes detailed requirements concerning who may serve process, how individuals and organizations may be served, proof of service and the time within which service ordinarily must occur.

Illinois likewise regulates who may serve process.

Under 735 ILCS 5/2-202, qualifying licensed or registered private detectives and registered employees of licensed private detective agencies may serve process in Illinois without special appointment, subject to the provisions of the statute.

This is why we believe process service deserves considerably more attention than simply asking:

“Did somebody knock on the door?”

The better questions about scenarios are:

Identifying the correct person or entity to be served

Verifying the address of service

Was the appropriate method of service used?

Were the circumstances accurately documented?

Was the affidavit accurate?

If service could not be completed, was useful information developed for the attorney?

And what should the investigative team do next within the scope of the assignment?

We Solve the Problem Around the Serve

A process server receives an address.

The legal solutions provider looks at the entire assignment.

Suppose an attorney sends us a defendant at 123 Main Street.

Our job may begin there.

It does not necessarily end there.

If reliable information indicates that the defendant moved six months earlier, continuing to knock on the same door accomplishes very little.

The problem has changed.

The issue is no longer simply:

Can we serve this address?

It has become:

Where is this person now?

That is an investigative question.

A skip trace may identify another address.

Additional records may help determine whether that address is current.

Field investigation may verify residency.

Once a reasonable location has been established, process service can resume.

The assignment has moved from:

Serve → fail

to:

Attempt → investigate → locate → verify → serve → document.

That is the Uthe Investigations & Process Service approach.

Difficult Service Requires Judgment, Not Just Attempts

No two difficult-service assignments are identical.

A defendant may work unusual hours.

A residence may appear vacant.

Vehicles connected with the subject may be present while no one answers the door.

Neighbors may provide conflicting information.

Database information may lead to several possible addresses.

A defendant may have recently moved.

The subject may divide time between multiple residences.

An address supplied by a client may simply be wrong.

These situations require professional judgment.

Depending upon the assignment, lawful investigative tools can help determine whether additional attempts at an address are reasonable or whether resources should instead be directed toward locating the individual elsewhere.

That is one reason Uthe Investigations & Process Service combines professional process service with legitimate investigative capability.

We are not merely trying doors. We are evaluating information.

Skip Tracing Is Part of the Solution

A name and an address are not necessarily the same thing as a verified location.

People move.

Addresses become stale.

Records conflict.

Family members share similar names.

Mailing addresses differ from residential addresses.

Public information may lag behind someone’s actual movements.

Effective locating therefore requires more than retrieving the first address appearing in a database.

Illinois’ private-detective statute specifically recognizes investigation into a person’s identity, activities, movements and whereabouts as private-detective functions. 225 ILCS 447/5-10.

Our objective is to develop information that is useful to the assignment—not merely produce another address.

That distinction is especially important when the ultimate objective is legal process service.

Investigation Can Support the Attorney’s Work Without Replacing the Attorney

The legal system depends upon facts as well as law.

Legal scholarship has long recognized fact investigation as part of effective legal representation and reliable judicial fact-finding. Modern scholarship continues to examine attorneys’ responsibility to investigate information rather than simply accept incomplete facts at face value.

That does not mean the investigator performs the lawyer’s function.

The roles are different.

The attorney determines the law, legal strategy and legal arguments.

The investigator develops information.

That information may include:

  • locating defendants and witnesses;
  • verifying addresses;
  • conducting skip traces;
  • researching public records;
  • documenting investigative findings;
  • developing information concerning identity or whereabouts;
  • conducting appropriate surveillance assignments;
  • researching relevant court records;
  • assisting with background investigations;
  • documenting service attempts;
  • and securing information or evidence for use by counsel.

Illinois law expressly includes “securing evidence to be used before any court, board, or investigating body” within the statutory definition of private-detective activity. 225 ILCS 447/5-10.

That is litigation support.

It is also problem solving.

One Assignment Can Require Several Disciplines

Consider a difficult family-law service assignment.

The attorney may initially need process served.

The supplied address proves incorrect.

Now a skip trace is required.

Several possible addresses are developed.

The information must be evaluated.

A likely current residence is identified.

Attempts begin.

Information developed in the field suggests the defendant may be deliberately avoiding contact.

The matter now requires more careful scheduling, documentation and potentially an investigative approach.

If service ultimately remains unsuccessful, counsel may need a detailed record of what was attempted and what investigation was conducted when considering the next procedural step.

What began as a process-service assignment has involved:

Process Service
Skip Tracing
Address Verification
Investigation
Field Intelligence
Due Diligence
Documentation

Hiring six different vendors to perform six isolated tasks is not the only way to handle that problem.

Uthe Investigations & Process Service was designed to bring those capabilities together.

Better Information Produces Better Decisions

We do not decide the client’s legal strategy.

We provide information that can help the attorney or client make informed decisions.

There is an important difference.

For example, we may determine that:

The address appears valid.

The defendant appears to have moved.

A newly developed address appears more current.

The available information does not establish a reliable current residence.

Multiple attempts produced no evidence that the subject currently occupies the residence.

Investigation developed another possible location.

Additional investigation may be appropriate before further attempts are made.

Those are investigative findings.

Counsel can then determine their legal significance and decide what procedural action, if any, should follow.

That separation protects both professions.

Documentation Is Part of the Work

Good field work that is poorly documented can create unnecessary problems.

Illinois law itself places importance on the server’s affidavit.

For service upon individuals, 735 ILCS 5/2-203 requires information concerning where and when service occurred and identifying characteristics of the person receiving process. The statute also imposes consequences for knowingly making false statements in a service affidavit.

Federal Rule of Civil Procedure 4 similarly requires proof of service and ordinarily requires that proof to be made by the server’s affidavit when service is not performed by a United States marshal or deputy marshal.

Our responsibility therefore does not stop when the papers leave the server’s hand.

The documentation matters too.

Legal Solutions for Attorneys

Law firms are an important part of our practice because attorneys frequently need more than one isolated service.

An attorney may need us to:

serve a summons;

locate an evasive defendant;

identify a possible new residence;

serve a subpoena;

develop background information;

locate a witness;

conduct a difficult-service investigation;

document unsuccessful service attempts;

coordinate lawful service outside our direct coverage area;

or provide investigative information relevant to ongoing litigation.

The common element is not the individual service.

It is the problem that needs to be solved.

Legal Solutions for Landlords and Property Professionals

Landlord matters can present the same combination of issues.

A former tenant may leave without providing a forwarding address.

A defendant may be difficult to locate after an eviction.

A landlord may require more comprehensive background information regarding a prospective tenant.

A property owner may need process served efficiently and properly documented.

Again, these assignments can involve several disciplines rather than a single transaction.

Our combination of process service, skip tracing, public-record research, background investigation and investigative experience allows us to approach the assignment as a complete problem rather than a collection of unrelated tasks.

Legal Solutions for Insurance and Civil Litigation

Civil and insurance matters also depend heavily upon accurate facts.

Witnesses move.

Defendants relocate.

Addresses become outdated.

Individuals connected with an incident may need to be located.

Records may need to be researched.

Statements or representations may need factual verification.

The Illinois private-detective statute expressly recognizes investigations concerning identity, conduct, whereabouts, accidents, injuries, truth or falsity of representations and evidence intended for court proceedings. 225 ILCS 447/5-10.

These are not abstract capabilities.

They are tools that can help resolve practical litigation problems.

What We Mean by “Legal Solutions Provider”

We use the phrase Legal Solutions Provider deliberately.

It does not mean law firm.

It does not mean attorney.

It does not mean legal advice.

Uthe Investigations & Process Service does not practice law and does not determine legal strategy for its clients.

Illinois law restricts the practice of law and the provision or advertising of legal services to those authorized to practice law. 705 ILCS 205/1.

Our role exists on the operational and investigative side of the legal system.

We:

Investigate.
Locate.
Verify.
Serve.
Document.
Report.
Help solve the problem.

Attorneys remain responsible for legal advice, legal interpretation, pleadings and litigation strategy.

That boundary is important to us.

So is being exceptionally good at the work that falls on our side of it.

We Are Not Just Process Servers

Process service is one of our core businesses.

We take it seriously.

But sometimes the process server reaches the end of what conventional process service can accomplish.

That is often where our investigative experience becomes most valuable.

Instead of simply reporting:

BAD ADDRESS — UNABLE TO SERVE

we want to know whether there is another reasonable avenue to pursue.

Can the individual be located?

Can the address be verified?

Is there another known residence?

Is there useful information that should be communicated to counsel?

Would additional investigation be appropriate?

What can we establish factually?

That is the difference between performing an attempt and approaching the assignment as a problem to be solved.

We Are Not Just Private Investigators

Investigation is also not performed in a vacuum.

Our investigative work frequently has an objective tied to a legal matter.

Locate the defendant.

Find the witness.

Verify the residence.

Develop the facts.

Document the activity.

Establish reasonable due diligence.

Find information the attorney can evaluate.

Then move the case forward.

The investigation has a purpose.

Investigate. Locate. Serve. Document.

Those four words describe much of what Uthe Investigations & Process Service has been doing since 1994.

Investigate the problem.

Locate the person, address, witness, record or information.

Serve the legal process when service is required.

Document what happened so the client knows exactly what was done.

The individual tools may be called private investigation, skip tracing, process service, due diligence, public-record research or litigation support.

We see something larger.

We see a legal problem requiring a practical solution.

And that is why Uthe Investigations & Process Service is more than a process-serving company and more than a private-investigation company.

We are legal solution providers.

Serving What Others Can’t. Experience That Protects Your Case.

Alias Buster™ – Solving One of the Biggest Problems in Process Service

One of the most common reasons legal matters become delayed is inaccurate or outdated address information. When a defendant, respondent, witness, or tenant no longer resides at the address provided, traditional process service often results in repeated unsuccessful attempts, unnecessary delays, and increased costs.

Alias Buster™ was developed by Uthe Investigations & Process Service to help identify address problems early in the process.

Rather than simply making repeated attempts at an address that may no longer be valid, Alias Buster™ combines professional process service with investigative resources to determine whether better address information may be available before a case stalls.

This proactive approach can help attorneys, landlords, insurance professionals, businesses, and private clients reduce delays while improving the likelihood of successful service.

If your assignment involves questionable address information, ask our office whether Alias Buster™ may be appropriate for your case.

Modern Digital Process Service Workflow

Many law firms appreciate receiving automatic updates throughout the service process rather than having to repeatedly contact the office for status requests. Today’s legal professionals expect efficient communication and modern technology.

Our digital workflow allows attorneys and legal staff to:

  • Submit documents electronically
  • Receive secure online invoices
  • Make online payments
  • Receive automatic email updates after each service attempt
  • Track assignment progress
  • Receive completed affidavits electronically

This streamlined process reduces unnecessary phone calls, improves transparency, and allows attorneys and legal staff to remain informed from assignment through affidavit completion. In many local jurisdictions, our office also files completed affidavits with the court and provides clients with a copy for their records.
