Not Every Illinois Process Server Operates Under the Same Authority

Hiring a process server may appear straightforward. Send the documents, provide an address, and wait for the affidavit.

Illinois law makes the underlying question more important:

Who is legally authorized to serve the process?

Under 735 ILCS 5/2-202, Illinois identifies several categories of people who may serve process. The statute includes sheriffs and other authorized persons. It also permits qualifying private detectives and registered employees of certified private detective agencies to serve process in any county without special appointment.

A court may also appoint a private person over the age of 18 who is not a party to the action. However, that authority requires a court order upon motion and in the court’s discretion.

For attorneys, those are meaningful differences.

The question is not simply whether someone calls themselves a process server. The question is what legal authority allows that person to serve your documents.


Does Illinois License Process Servers?

The terminology can be confusing.

Illinois does not simply issue one generic statewide license called an “Illinois Process Server License.”

Instead, Illinois law establishes categories of people who are authorized to serve process.

One important category involves the private detective industry.

Section 2-202 permits a person licensed or registered as a private detective under the applicable Illinois licensing Act to serve process without special appointment. It provides similar authority to registered employees of certified private detective agencies.

The statute specifically identifies an agency employee holding a valid Permanent Employee Registration Card (PERC) as one category of registered employee. It also recognizes certain pending PERC applicants, qualifying current peace officers, and licensed private detectives working as agency employees.

Therefore, the terms licensed, registered, specially appointed, and unlicensed should not be used interchangeably.

The underlying legal authority matters.


A PERC Is Not an Independent Process Server License

A common misconception deserves clarification.

Possessing a PERC does not, by itself, make someone an independently licensed Illinois Private Detective or Private Detective Agency.

Illinois law imposes an employment requirement on PERC holders performing regulated activities. Under 225 ILCS 447/35-32, a PERC holder may not perform covered private detective activities without employment by an agency licensed under the Act.

The law goes further. A licensed agency may not evade employee-registration requirements simply by classifying an otherwise unlicensed person as a contractor or independent contractor. The statute provides an exception when that person is independently licensed under the Act.

For process service, §2-202 likewise describes a qualifying PERC holder as an employee who works for the private detective agency.

That distinction leads to an important question for attorneys:

Is the person holding a PERC actually serving through the licensed agency framework recognized by Illinois law?


What Is a Special Process Server Appointment?

Illinois provides another avenue for private individuals who do not otherwise have authority to serve the process at issue.

Section 2-202 allows the court, upon motion and in its discretion, to order service by a private person who is over 18 and not a party to the action.

That person becomes specially appointed to perform the service authorized by the court.

This procedure differs significantly from the statutory authority available to qualifying private detectives and registered employees of certified private detective agencies.

A qualifying registered agency employee does not need a new special appointment merely because another qualifying service assignment arrives.

A private person relying on special appointment must obtain the necessary court authority.

That difference becomes especially important when time matters.


Why Special Appointment Can Affect Rush and Same-Day Service

Legal deadlines do not always provide several days of advance notice.

A summons may be nearing expiration. An attorney may need a subpoena served quickly. A defendant may only be available for a short period. Another process server may have failed shortly before a critical deadline.

In those situations, the ability to begin work promptly can matter.

When the proposed server requires a special appointment, service cannot lawfully proceed under that appointment until the court grants the necessary authority.

By contrast, §2-202 provides qualifying private detectives and registered employees of certified private detective agencies with authority to serve process without obtaining a separate special appointment for each qualifying case.

Same-day service is not only a question of whether someone is available today. The person must also have legal authority to make the attempt today.

I would use that sentence prominently on the page.

I would not state that Illinois special appointments universally take three days. Court processing time can vary, and §2-202 does not establish a three-day statutory waiting period.


Why a Licensed Illinois Private Detective Agency Is Different

A Licensed Illinois Private Detective Agency provides more than a company name behind the person knocking on the door.

Illinois law creates an agency framework for registered employees performing process service.

Under §2-202, a private detective agency must maintain a list of its registered employees. The statute also requires the agency to provide that list to a sheriff’s department upon request within five business days. Private detective agencies must also provide their agency certificate to county sheriffs where they or their employees serve process as required by the statute.

For law firms, this creates an identifiable agency relationship behind the assignment.

It also allows process service to operate within a professional structure that includes supervision, documentation, communication, and accountability.


Questions Attorneys Should Ask Before Hiring an Illinois Process Server

Price and turnaround time matter. However, neither answers the legal-authority question.

Before assigning Illinois process, consider asking:

Who will actually serve my documents?

Under what authority will that person perform service?

Is the individual independently licensed or properly registered through a Licensed Illinois Private Detective Agency?

If the person holds a PERC, what licensed agency employs that individual?

Will this case require a special process server appointment before attempts can begin?

Can the provider begin a legitimate rush assignment immediately?

Who supervises the field personnel?

How are service attempts documented?

What happens when the address is wrong or the defendant becomes evasive?

These questions become particularly important when service involves a significant deadline.


Not Every Illinois Process Service Provider Has the Same Authority

Not every company advertising Illinois process service operates under the same legal authority. Illinois law provides different methods for serving process, and the authority of the person completing service can matter. Before assigning legal documents, attorneys and litigants should understand who is actually authorized to serve their process and under what authority they are acting.

Licensed Does Not Automatically Mean Better — But Authority Matters

Licensing alone does not guarantee successful service.

Experience matters. Communication matters. Professional judgment matters. Accurate affidavits matter.

However, those considerations come after determining whether the person performing service has appropriate legal authority.

Likewise, describing someone as “unlicensed” does not automatically mean that person cannot lawfully serve process. Illinois courts can specially appoint qualifying private individuals. Sheriffs and other categories identified by law also have service authority independent of private detective licensure.

That is why Uthe Investigations & Process Service LLC does not reduce this issue to:

Licensed = legal. Unlicensed = illegal.

The accurate question is:

Under what statutory or court-granted authority is this particular person serving this particular process?

That is the distinction attorneys should understand.

An attorney hiring an Illinois process server should not have to become an expert in occupational licensing law.

However, one simple question can prevent confusion:

“Under what legal authority will the person serving my documents act?”

The answer may involve a sheriff, a licensed private detective, a registered employee of a certified private detective agency, a special court appointment, or another category authorized by law.

What matters is that the answer exists before service occurs.

For attorneys facing urgent assignments, that question becomes even more important.

Availability means little if the person available to make the attempt does not yet have the authority to serve the process.
