Not Every Company Advertising “Illinois Process Service” Has the Same Authority

Finding someone online who advertises process service in Illinois is easy.

Determining whether that person or company has the legal authority to perform the service you are hiring them to perform deserves more attention.

Illinois law does not simply provide that anyone who calls themselves a “process server” may serve original process throughout the state without further authorization. Instead, Illinois law identifies categories of persons authorized to serve process and provides a mechanism through which a court may appoint a private person to make service.

For attorneys, law firms, landlords, businesses, and other litigants, that distinction matters.

The question should not simply be:

“Do you serve legal documents?”

A better question is:

“What is your legal authority to serve this process in Illinois?”

Illinois Law Determines Who May Serve Process

Section 2-202 of the Illinois Code of Civil Procedure governs persons authorized to serve process.

Under 735 ILCS 5/2-202, process may be served by persons specifically authorized under Illinois law. The statute also provides that process in any Illinois county may be served without special appointment by a person licensed or registered as a private detective under the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004, or by a registered employee of a private detective agency certified under that Act.

The court may also, in its discretion and upon motion, order service by a private person who is at least 18 years old and is not a party to the action.

These are important distinctions.

Simply operating a process service company, advertising process service online, or having experience delivering legal documents does not by itself establish the statutory authority under which a particular person is serving process.

Process Server Is Not an Illinois Professional License

The term “process server” can create confusion.

Illinois does not issue a general statewide professional license simply titled “Process Server License” that independently gives every holder statewide authority to serve process.

Instead, authority depends upon the applicable Illinois statutes, the status of the individual performing the service, and, when required, court authorization.

Therefore, two businesses that both advertise themselves as Illinois process service companies may be operating under very different legal structures.

One may be a licensed Illinois private detective agency using properly registered personnel.

Another individual may be serving pursuant to a specific court appointment.

Another may operate under some other authority applicable to the particular service.

The important issue is not the title printed on a website or business card.

The important issue is the legal authority under which the service is being performed.

Illinois Specifically Recognizes Private Detective Process Service

Illinois law expressly includes service of process in civil and criminal proceedings within the statutory definition of private detective activities.

That matters.

Licensed private detectives and qualifying registered employees of licensed private detective agencies occupy a specifically recognized position within Illinois process service law.

Under 735 ILCS 5/2-202, qualifying private detectives and registered agency employees may serve process in any Illinois county without obtaining a special appointment for each individual case, subject to the applicable statutory requirements.

For law firms managing significant volumes of litigation, that can provide an important operational advantage.

A PERC Card Is Not a Private Detective License

Another area of frequent confusion involves the Permanent Employee Registration Card, commonly called a PERC.

A PERC is not the same thing as an individual Illinois private detective license.

It is also not an Illinois private detective agency license.

Illinois law specifically provides that a PERC holder may not independently perform private detective activities without being employed by an agency licensed under the applicable Act.

Therefore, simply possessing a PERC does not independently authorize someone to operate a private detective business or hold themselves out as a licensed private detective agency.

The relationship between the registered employee and the licensed agency matters.

Independent Contractors Present Another Important Question

Illinois law also addresses attempts to avoid employee-registration requirements through the use of contractors.

Under the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004, a licensed agency may not evade employee-registration requirements by engaging a contractor or independent contractor to perform regulated private detective activities unless that individual is independently licensed under the Act.

This is particularly important in an industry where work is frequently subcontracted.

When a process service company accepts an assignment and then sends another person into the field, attorneys may reasonably want to know:

Who is actually performing the service, and under what authority are they doing it?

Court-Appointed Special Process Servers Are Different

Illinois courts also have authority to appoint qualified private individuals to serve process.

Under 735 ILCS 5/2-202, a court may, upon motion and in its discretion, order service by a private person who is over 18 and not a party to the action.

That person does not become a licensed private detective simply because the court authorized service.

Instead, the authority derives from the court’s appointment for the applicable matter.

This distinction is important because court-appointed authority and private-detective licensing are two different legal pathways to authorized service.

Why Licensing Matters Beyond the Act of Service

Licensing is not merely a title.

Illinois imposes substantial requirements on people entering the private detective profession.

Applicants must satisfy statutory qualifications and licensing requirements established by the Illinois Department of Financial and Professional Regulation.

Current IDFPR licensing materials also require proof of at least $1,000,000 in commercial general liability insurance for private detective licensure.

These requirements create accountability that does not necessarily exist simply because someone advertises process service on the Internet.

Why Attorneys Should Care

Process service is not merely document delivery.

Service establishes notice and can become an important jurisdictional issue in litigation.

When service is challenged, the circumstances surrounding the attempt may be scrutinized.

Questions may include:

  • Who performed the service?
  • What authority did that individual have?
  • How was service accomplished?
  • Was substitute or abode service performed correctly?
  • What observations did the server make?
  • What documentation supports the affidavit?
  • Can the server testify regarding the service if necessary?

A low price for service can become expensive if defective service results in additional motions, delays, hearings, or repeated attempts.

Questions Law Firms Can Ask a Process Service Provider

Before sending assignments to an Illinois process service company, attorneys and legal professionals may want to ask:

Are you an Illinois licensed private detective agency?

Who will actually perform my service?

Is that individual properly licensed or registered under the agency?

If you are not operating under private detective authority, will a court appointment be required for this matter?

What happens if the individual performing service is later required to testify?

Can I verify the applicable professional license through IDFPR?

A professional process service provider should be comfortable answering those questions.

Verify Illinois Licensing

Illinois private detective licensing is administered by the Illinois Department of Financial and Professional Regulation.

Attorneys and consumers can independently verify professional licensing through IDFPR’s license lookup resources.

Verification is simple.

Before entrusting an important summons, subpoena, complaint, eviction matter, family law case, or other legal process to a provider, determine who will actually perform the service and under what authority.
