Who Can Legally Serve Process in Illinois | Uthe Investigations
Who Can Legally Serve Process in Illinois?
Many attorneys, legal assistants, landlords, businesses, and private clients assume Illinois issues a “Process Server License.” Surprisingly, Illinois does not issue a standalone process server license.
As a result, confusion frequently occurs when an individual advertises process service and provides a license number as proof of authority. In many cases, the individual may be referencing a Permanent Employee Registration Card (PERC) issued by the Illinois Department of Financial and Professional Regulation (IDFPR). A PERC is an employee registration—not a process server license and not a private detective license.
Understanding who is legally authorized to serve process in Illinois is important because improper service can result in delays, additional expense, motions to quash service, and the need to reserve the defendant. Illinois law specifically identifies who may lawfully serve process and under what circumstances.
Illinois Does Not Issue a Process Server License
One of the most common misconceptions in the legal industry is the belief that Illinois issues a process server license.
Illinois does not license process servers as a separate profession. Instead, Illinois law authorizes specific individuals and entities to perform service of process. The authority to serve process comes from the Illinois Code of Civil Procedure and, in some circumstances, from court appointment.
For attorneys evaluating a process server, the better question is often:
“Under what authority is this person serving process?”
Why Proper Authority Matters
Most process service assignments proceed without issue.
However, when service becomes contested, questions may arise regarding whether the person completing service was legally authorized to do so. Challenges to service can result in motions to quash, additional hearings, re-service expenses, delayed litigation, and increased costs for clients.
For that reason, attorneys should not simply ask whether a person is “licensed.” Instead, attorneys should understand what type of credential is being presented and under whose authority the service is being performed.
A license number alone does not answer that question.
The more important question is:
“Who is the licensed Illinois Private Detective Agency responsible for this assignment?”
Understanding the differences between licensed private detectives, registered employees, court-appointed special process servers, and other service providers can help attorneys reduce risk and make informed decisions regarding process service.

Who May Legally Serve Process in Illinois?
Illinois law generally recognizes the following categories of individuals who may serve process:
Sheriffs
The sheriff remains the traditional process server throughout Illinois. In many cases, attorneys may choose to utilize the sheriff’s office for service of process.
Licensed Private Detectives
Illinois law authorizes licensed private detectives to serve process. These individuals are licensed and regulated through the Illinois Department of Financial and Professional Regulation.
Registered Employees of Licensed Private Detective Agencies
Illinois law also authorizes registered employees working under a licensed Illinois Private Detective Agency to serve process. The employee’s authority is derived from the licensed agency relationship and the regulatory structure established by Illinois law.
Court-Appointed Special Process Servers
Illinois courts may appoint a private individual over the age of 18 who is not a party to the action to serve process in a specific case. This authority comes from the court’s appointment order and applies only to the matter for which the appointment was granted.
Understanding the Difference Between a PERC and a Private Detective License
This distinction causes significant confusion.
A PERC is a Permanent Employee Registration Card issued by IDFPR. It allows an individual to work as a registered employee under a licensed agency. A PERC is not a private detective license and does not create an independent process service business.
Think of the relationship this way:
A paralegal may perform important legal work, but the authority to practice law belongs to the attorney and law firm.
Similarly, a registered employee may perform process service while operating under the authority and supervision of a licensed Illinois Private Detective Agency. The agency license, regulatory oversight, insurance coverage, supervision, and accountability structure remain important components of that relationship.
Why Attorneys Should Care
Most process service assignments are never challenged.
However, when service becomes contested, courts may examine who performed the service and under what authority. Questions regarding authorization, appointment, service methods, affidavits, and statutory compliance can become important when a defendant attempts to challenge service. Improper service can create unnecessary delays and additional costs.
For that reason, attorneys should consider asking:
Is the individual a licensed Private Detective?
Is the individual a registered employee of a licensed Private Detective Agency?
What agency is responsible for the assignment?
Is the agency currently licensed through IDFPR?
Who supervises the assignment and stands behind the affidavit?
These questions help identify who is responsible for the service and what regulatory framework supports the assignment.
The Advantage of Working with a Licensed Illinois Private Detective Agency
A licensed Illinois Private Detective Agency often provides more than basic process service.
In addition to service of process, licensed agencies may provide:
Skip tracing
Background investigations
Social media investigations
Surveillance
Asset research
Witness location services
Litigation support
When defendants relocate, avoid service, provide inaccurate information, or require additional investigative efforts, these resources may become valuable.
