You may know that something needs to be served, but what happens after that? When will the process server attempt service? How will you know what happened? What if the tenant does not answer the door? What happens after the notice period expires?

Uthe Investigations & Process Service works with Illinois landlords and property managers to make the process service portion of a landlord matter as organized and understandable as possible.

Our system is designed around electronic submission, detailed service attempts, automatic status notifications, and professional documentation.

This guide explains what landlords can generally expect from beginning to end.

The Process Begins with the Correct Documents

Before anything can be served, you need the appropriate documents for your situation.

Depending upon the circumstances, a landlord matter may involve documents such as a:

Uthe Investigations & Process Service serves the documents provided to us. We do not select or prepare legal notices for landlords unless specifically authorized and legally permitted to do so.

If you are unsure which document you need, consult an attorney before submitting the assignment.

Submit Your Documents Electronically

Uthe Investigations & Process Service operates through a modern electronic workflow.

You do not need to visit our office or meet with a process server.

Provide the documents and information requested for your assignment electronically, including accurate information about the person or persons being served.

The more useful information you provide at the beginning, the better prepared our office and process server will be.

Helpful information may include:

  • Full legal name of each person being served
  • Complete service address
  • Apartment or unit number
  • Known phone number, when available
  • Physical description, when known
  • Vehicle description
  • Known work or personal schedule
  • Access instructions for secured properties
  • Information about dogs or other safety concerns
  • Any known history of threatening or evasive behavior

Do not assume that information is unimportant.

Something as simple as a vehicle description or known work schedule may become valuable if service becomes difficult.

Payment and Assignment Setup

Once the required documents, information, and payment have been received, the assignment can be prepared for service.

Our office reviews the information provided and assigns the matter according to the requested service level and service area.

Landlord and pro-se assignments may have different pricing or procedures from attorney-submitted process service.

Before submitting your case, review our current pricing and service options so you understand what is included.

Your Process Server Begins the Attempts

Once dispatched, the process server attempts service according to the assignment and applicable service level.

Not every attempt results in immediate service.

A tenant may:

  • Not be home
  • Fail to answer the door
  • Work unusual hours
  • Have restricted building access
  • Be temporarily away
  • Have moved
  • Be difficult to identify
  • Appear to be avoiding service

An unsuccessful first attempt does not necessarily mean something has gone wrong.

Process service is often a process.

Each attempt can also provide information that helps determine what should happen next.

You Receive Automatic Status Updates

This is one of the most important parts of our system for landlords to understand.

You do not need to call the office after every attempt.

When an attempt is completed and entered into our system, status information is sent electronically.

Please monitor your email for updates.

Depending upon the assignment, the report may include observations such as:

  • Date and time of the attempt
  • Whether anyone answered
  • Relevant conversations
  • Vehicles observed
  • Signs of occupancy
  • Information developed at the location
  • Other observations relevant to the service attempt

Our goal is to provide meaningful information rather than simply reporting:

“No Answer.”

Because status updates are provided electronically, calling or texting the office generally will not provide newer information than what has already been reported by the process server.

If there is a meaningful development requiring your attention, our office will contact you.

What Happens If the Tenant Does Not Answer?

Do not panic after one unsuccessful attempt.

It is common for process servers to encounter unanswered doors.

The server will continue according to the service level purchased and the circumstances of the assignment.

Meanwhile, information developed during previous attempts may help guide later attempts.

For example, the server may observe:

  • Different vehicles
  • Patterns of activity
  • Signs that the residence is occupied
  • Information suggesting the tenant has moved
  • Information that may help identify a better time for another attempt

This is why detailed attempt reporting matters.

What If We Believe the Tenant Is Avoiding Service?

Some defendants are simply difficult to catch.

Others may appear to be intentionally avoiding the process server.

Those are different situations, and difficult service sometimes requires a different strategy.

Depending upon the circumstances, Uthe Investigations & Process Service may discuss additional options such as:

  • Skip tracing or address verification

  • Maximum Serve™

Additional services and fees may apply.

We do not automatically add enhanced services without authorization.

Before the Final Standard Attempt: The Landlord’s Secret Weapon™

When previous attempts have been unsuccessful but useful information has been developed, qualifying landlord assignments may have another strategic option.

For an additional fee, The Landlord’s Secret Weapon™ may be deployed before the fourth and final standard attempt.

This proprietary service creates a collaboration between:

The landlord + Uthe Investigations & Process Service + the process server.

We review what has been learned during previous attempts and combine it with the landlord’s firsthand knowledge.

Perhaps you know when the tenant normally leaves for work.

Maybe you recognize their vehicle.

Perhaps you know when they pick up their children, walk their dog, return home, or follow another predictable routine.

That information may help us develop a strategically timed final attempt rather than simply making another routine visit.

There is never a guarantee that any attempt will result in successful service.

However, when service becomes difficult, better information can create a better strategy.

When Service Is Successful

Once service has been completed, the process server documents the circumstances of service.

The appropriate proof or affidavit of service is then prepared according to the requirements of the assignment.

Depending upon the type of document and court involved, additional procedures may be required.

Keep all service documentation with your case records.

Successful service of a document does not necessarily mean the landlord matter itself is complete.

It means the process service portion of that particular assignment has been completed.

What Happens After a Landlord Notice Is Served?

This distinction is extremely important.

Serving a landlord notice and serving an eviction lawsuit are not necessarily the same assignment or the same stage of the process.

After a required notice has been properly served, an applicable notice period may need to expire before further legal action can be taken.

What happens next depends upon the type of notice, the facts of the tenancy, applicable law, and whether the tenant complies.

For example, the tenant may:

  • Pay amounts claimed to be due
  • Correct an alleged violation
  • Move from the property
  • Dispute the landlord’s position
  • Remain after the applicable period

If further legal action is necessary, the landlord may need to proceed through the appropriate court process.

Uthe Investigations & Process Service cannot tell a pro-se landlord whether or when they should file an eviction lawsuit. Consult an attorney or appropriate court resources if you need legal guidance.

Filing an Eviction Case Creates a New Service Assignment

If an eviction case is filed with the court, new documents are generally issued for service.

These may include an eviction summons, complaint, and other court documents.

This is a new process service assignment.

Do not assume that because Uthe Investigations & Process Service served the original landlord notice, we automatically receive documents issued later by the court.

If you want us to serve newly issued court documents, they must be submitted to us as a new assignment with the necessary information and payment.

Court Dates and Deadlines Are the Landlord’s Responsibility

Landlords should carefully monitor all court dates, filing deadlines, expiration dates, and legal requirements associated with their case.

Process servers do not manage the underlying lawsuit for pro-se litigants.

Do not wait until the last possible day to submit documents for service.

The more time available for service, the more opportunity the process server has to make meaningful attempts and adjust strategy when necessary.

If You Obtain a Judgment

A successful eviction case may eventually result in court orders concerning possession, money owed, or other relief.

A judgment does not necessarily mean money will automatically be collected.

Likewise, process servers do not enforce possession orders or perform functions reserved by law for the sheriff or other authorized officials.

If you obtain a monetary judgment and need assistance understanding possible collection options, Uthe Investigations & Process Service may be able to provide information regarding appropriate third-party collection resources.

We are not a collection agency and do not guarantee collection of judgments.

As a Landlord, you want the tenant served.

You want to know what happened.

However, repeatedly calling, emailing, or texting the office does not make a process server reach the property sooner and usually does not provide information beyond the automatic updates already being generated.

The most efficient way to work with us is:

Submit complete and accurate information at the beginning.

Monitor your email for automatic status updates.

Respond promptly if our office requests additional information.

Tell us immediately if you learn something that could materially assist service.

Allow the process server to work the assignment.

If something requires your involvement, we will contact you.

Information Changes Everything

If you learn something important while service is underway, tell us.

For example:

“His truck is there right now.”

“She works nights and gets home around 7:00 a.m.”

“The tenant moved to another unit.”

“That vehicle belongs to the defendant.”

“The defendant threatened the landlord or process server.”

That information may materially change the service strategy.

Do not wait until all attempts have been exhausted to provide information you already possess.

Process service is not an appointment with the defendant.
